This morning (yesterday morning), Martin Alderete, defense lawyer of Daniel Ruiz and member of the CADEP (Anti-repression Coordinator for the Rights of the People; T.N.), submitted the request for release before the Oral Tribunal in the Federal Criminal n 3.
Daniel has been imprisoned in the Marcos Paz Penal for three months, as ordered by Mauricio Macri and Minister Bullrich for no legal reason.
Judge Torres prosecuted him for public intimidation and undermining of the law, two felonies that do not entail prison time. Therefore, if there were a sentence against Daniel, he would be free. Judge Torres and the Chamber of Appeal in the Criminal and Correctional basically used four arguments to deny the release.
They said that Daniel should be imprisoned because in freedom he could represent a risk for the investigation. However, the investigation finished and the cause was taken to Oral Trial. For this reason, it no longer exists. They also said that the Prosecutor had posed that possibly, Daniel had incurred in the felony of Rebellion therefore due to the possible seriousness he had to remain imprisoned.
This argument also fell because the Prosecutor requested to raise to trial, accusing Daniel of public intimidation and of undermining the law, not for rebellion.
The third argument was on the possible fleeing. They were unable to demonstrate this because Daniel is a well-known oil union leader in Comodoro Rivadavia, where he was born, he lives and has a daughter, two sisters, a brother nephews and nieces.
The fourth argument is purely political and evidences the will to use preventive prison as an exemplary punishment. They refused the release because our comrade Sebastian Romero is a fugitive and Daniel belongs to the same party.
This is the way the justice of Torres, Irurzún and the Chamber of Appeals works. They refused to deal with the subject, but they dismissed Mauricio Macri due to the illegal wiretapping.
Tenths of human rights bodies, presented an Amicus Curiae to the Oral Court n3, worried for to the imprisonment of Daniel Ruiz. Among them, the Founding Line of the May Plaza Mothers, with the signature of Taty Almeida, María Elena Naddeo on behalf of APDH (Permanent Assembly for Human Rights), Lita Boitano from Family of Missing and Arrested for Political Reasons, the Ecumenical Movement for Human Rights, Graciela Rosemblum from the Argentinian League for the Rights of Men, and many other bodies of great importance.
The Association of Formerly Imprisoned Missing, Correpi, Liber Pueblo and important human rights bodies that make up the Encuentro Memoria Verdad y Justicia (Truth and Justice Memory Encounter) will also present one.
On behalf of Daniel, we thank all of them for the support they have provided.
We know that Daniel is imprisoned due to an order of Mauricio Macri and Minister Bullrich, as an exemplary punishment for facing the robbery of the retired on December 18.
For this, we continue with the political campaign along with all the human rights bodies and political, labor and social organizations that have supported Daniel since day one. Demanding his immediate freedom. We set all our hopes in the struggle of the workers and the people.
